All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

I’ve known about conversational implicature a lot longer than I’ve known Larry. In 1967 I read Grice’s “Logical and Conversation” in mimeograph, shortly after his William James lectures, and I read its precursor “(Implication),” section III of “The Causal Theory of Perception”, well before that. And I’ve thought, read, and written about implicature off and on ever since. Nevertheless, I know a lot less about it than Larry does, and that’s not even taking into account everything he has (...) uncovered about what was said on the subject long before Grice, even centuries before. So, now that I’ve betrayed my ignorance, I’ll display my insolence. I’m going to identify the most pervasive and pernicious misconceptions about implicature that I’ve noticed over the years. What is the best account of process reliabilism about epistemic justification, especially epistemic entitlement? I argue that entitlement consists in the normal functioning (proper operation) of the belief-forming process when the process has forming true beliefs reliably as an etiological function. Etiological functions involve consequence explanation: a belief-forming process has forming true beliefs reliably as a function just in case forming-true beliefs reliably partly explains the persistence of the process. This account paves the way for avoiding standard objections to process (...) reliabilism and situations epistemic entitlement within a normative framework of functions and functional norms. (shrink)

Are individuals responsible for the consequences of actions taken by their community? What about their community's inaction or its attitudes? In this innovative book, Larry May departs from the traditional Western view that moral responsibility is limited to the consequences of overt individual action. Powerful emotion and pursuit of self-interest have many times led people to break the law with the belief that they are doing so with sound moral reasons. This study is a comprehensive philosophical and legal analysis of the gray area in which the foundations of law and morality clash. This objective book views these oblique circumstances from two perspectives: that of the person who faces a possible conflict between the claims of morality and law and must choose whether or not (...) to obey the penal code; and that of the people who make and uphold laws and must decide whether to treat someone with a moral claim to disobey differently from ordinary lawbreakers. In examining the extent of the obligations owed by citizens to their government, Greenawalt concentrates on the possible existence of a single source of obligation that reaches all citizens and all laws. He also discusses techniques of amelioration of punishment for conscientious lawbreakers, asking how far legal systems should go to accomodate individuals who break the law for reason of conscience. How far may Americans properly rely on their religious beliefs when they make and defend political decisions? For example, are ordinary citizens or legislators doing something wrong when they consciously allow their decisions respecting abortion laws to be determined by their religious views? Despite its intense contemporary relevance, the full dimensions of this issue have until now not been thoroughly examined. Religious Convictions and Political Choice represents the first attempt to fill this gap. Beginning with an account of the basic (...) premises of our liberal democracy, Greenawalt moves to a comparison between rational secular grounds of decision and grounds based on religious convictions. He discusses particular issues such as animal rights and abortion, showing how religious convictions can bear on an individual's decisions about them, and inquires whether reliance on such convictions is compatible with liberal democratic premises. In conclusion, he argues that citizens cannot be expected to rely exclusively on rational, secular grounds. (shrink)

Embodied Cognition is an approach to cognition that departs from traditional cognitive science in its reluctance to conceive of cognition as computational and in its emphasis on the significance of an organism's body in how and what the organism thinks. Three lines of embodied cognition research are described and some thoughts on the future of embodied cognition offered.

In this, the first major philosophical study of contingent pacifism, Larry May offers a new account of pacifism from within the Just War tradition. Written in a non-technical style, the book features real-life examples from contemporary wars and applies a variety of approaches ranging from traditional pacifism and human rights to international law and conscientious objection. May considers a variety of thinkers and theories, including Hugo Grotius, Kant, Socrates, Seneca on restraint, Tertullian on moral purity, Erasmus's arguments against just (...) war, and Hobbes's conception of public conscience. The guiding idea is that the possibility of a just war is conceded, but not at the current time or in the foreseeable future due to the nature of contemporary armed conflict and geopolitics - wars in the past are also unlikely to have been just wars. Demystifying Legal Reasoning defends the proposition that there are no special forms of reasoning peculiar to law. Legal decision makers engage in the same modes of reasoning that all actors use in deciding what to do: open-ended moral reasoning, empirical reasoning, and deduction from authoritative rules. This book addresses common law reasoning when prior judicial decisions determine the law, and interpretation of texts. In both areas, the popular view that legal decision makers practise special forms of reasoning is false.

There is extensive discussion in current Just War literature about the normative principles which should govern the initiation of war (jus ad bellum) and also the conduct of war (jus in bello), but this is the first book to treat the important and difficult issue of justice after the end of war. Larry May examines the normative principles which should govern post-war practices such as reparations, restitution, reconciliation, retribution, rebuilding, proportionality and the Responsibility to Protect. He discusses the emerging (...) international law literature on transitional justice and the problem of moving from a position of war and possible mass atrocity to a position of peace and reconciliation. He questions the Just War tradition, arguing that contingent pacifism is most in keeping with normative principles after war ends. In this volume, the third in his trilogy on the philosophical and legal aspects of war and conflict, Larry May locates a normative grounding for the crime of aggression - the only one of the three crimes charged at Nuremberg that is not currently being prosecuted - that is similar to that for crimes against humanity and war crimes. He considers cases from the Nuremberg trials, philosophical debates in the Just War tradition, and more recent debates about the International (...) Criminal Court, as well as the hard cases of humanitarian intervention and terrorist aggression. His thesis refutes the traditional understanding of aggression. At Nuremberg, crimes against humanity charges were only pursued if the defendant also engaged in the crime of aggression. May argues for a reversal of this position, contending that aggression charges should be pursued only if the defendant's acts involve serious human rights violations. (shrink)

Axiomatic utility theory plays a foundational role in some accounts of normative principles. In this context, it is sometimes argued that transitivity of “better than” is a logical truth. Larry Temkin and Stuart Rachels use various examples to argue that “better than” is non–transitive, and that transitivity is not a logical truth. These examples typically involve some sort of “discontinuity.” In his discussion of one of these examples, John Broome suggests that we should reject the claim which involves “discontinuity.” (...) We can, I suggest, make sense of the examples which Temkin uses while sacrificing neither transitivity nor “discontinuity.” This response to Temkin's examples involves developing and modifying James Griffin's account of “discontinuity.” If the account of “discontinuity” seems implausible, that is because of a failure to allow for vagueness. Leibniz viewed the principle of continuity, the principle that all natural changes are produced by degrees, as a useful heuristic for evaluating the truth of a theory. Since the Cartesian laws of motion entailed discontinuities in the natural order, Leibniz could safely reject it as a false theory. The principle of continuity has similar implications for analyses of Leibniz's theory of consciousness. I briefly survey the three main interpretations of Leibniz's theory of consciousness and argue that the standard account entails (...) a discontinuity that Leibniz could not allow. I argue that the principle of continuity and the textual data favor an interpretation according to which a conscious mental state just is a perception that is distinct to a sufficient degree. In this comprehensive treatise Greenawalt explores the three-way relationship between the idea of freedom of speech, the law of crimes, and the many uses of language. He begins by considering free speech as a political principle, and after a thorough and incisive analysis of the justifications commonly advanced for freedom of speech, looks at the kinds of communications to which the principle of free speech applies. He then turns to (...) an examination of communications for which criminal liability is fixed. Focusing on threats and solicitations to crime, he attempts to determine whether liability for such communications seriously conflicts with freedom of speech. In this provocative book, Alexander offers a sceptical appraisal of the claim that freedom of expression is a human right. He examines the various contexts in which a right to freedom of expression might be asserted and concludes that such a right cannot be supported in any of these contexts. He argues that some legal protection of freedom of expression is surely valuable, though the form such protection will take will vary with historical and cultural circumstances and is not a (...) matter of human right. What does it mean to be a morally responsible man? Psychology and the law have offered reasons to excuse men for acting aggressively. In these philosophically reflective essays, Larry May argues against standard accounts of traditional male behavior, discussing male anger, paternity, pornography, rape, sexual harassment, the exclusion of women, and what he terms the myth of uncontrollable male sexuality. While refuting the platitudes of the popular men's movement, his book challenges men to reassess and change behavior that has (...) had detrimental effects on the lives of women and of men. In May's view, the key to solving many problems is to understand how individual actions may combine to produce large-scale, harmful consequences. May is eager to reconceptualize male roles in ways that build on men's strength rather than rendering them androgynous. Each chapter in his book suggests strategies to effect changes based on May's views on the nature of moral responsibility. Examining separatism and the socialization of youth in athletics and the military, specifically at Virginia Military Institute and the Citadel, May analyzes the moral implications of the way all-male environments are constructed. There is also an increase in ambient scenting in stores and hotels and leading chefs are adding unusual scents to cuisine. McCawley supplements his earlier book—which covers such topics as presuppositional logic, the logic of mass terms and nonstandard quantifiers, and fuzzy logic—with new material on the logic of conditional sentences, linguistic applications of type theory, Anil Gupta's work on principles of identity, and the generalized quantifier approach to the logical properties of determiners.

In this article, I develop a higher-order interpretation of Leibniz's theory of consciousness according to which memory is constitutive of consciousness. I offer an account of Leibniz's theory of memory on which his theory of consciousness may be based, and I then show that Leibniz could have developed a coherent higher-order account. However, it is not clear whether Leibniz held (or should have held) such an account of consciousness; I sketch an alternative that has at least as many advantages as (...) the higher-order theory. This analysis provides an important antecedent to the contemporary discussions of higher-order theories of consciousness. (shrink)

Leibniz explains both activity and sensation in terms of the relative distinctness of perception. This paper argues that the systematic connection between activity and sensation is illuminated by Leibniz’s use of distinctness in analyzing each. Leibnizian sensation involves two levels of activity: on one level, the relative forcefulness of an expression enables certain expressions to stand out against the perceptual field, but in addition to this there is an activity of the mind that enables sensory experience. This connection of mental (...) activity and perceptual distinctness enables us to better appreciate the fundamental role perceptual distinctness plays in Leibniz’s theory of sensation. (shrink)

This paper examines the role of evidential considerations in relation to pragmatic concerns in statements of group belief, focusing on scientific collaborations that are constituted in part by the aim of evaluating the evidence for scientific claims (evidential collaborations). Drawing upon a case study in high energy particle physics, I seek to show how pragmatic factors that enter into the decision to issue a group statement contribute positively to the epistemic functioning of such groups, contrary to the implications of much (...) of the existing discussion of group belief. I conclude by suggesting that applying social epistemological considerations to scientific collaborations could be practically beneficial, but only if an appropriately broad range of epistemic values is considered. Experimenters sometimes insist that it is unwise to examine data before determining how to analyze them, as it creates the potential for biased results. I explore the rationale behind this methodological guideline from the standpoint of an error statistical theory of evidence, and I discuss a method of evaluating evidence in some contexts when this predesignation rule has been violated. I illustrate the problem of potential bias, and the method by which it may be addressed, with an example from the (...) search for the top quark. A point in favor of the error statistical theory is its ability, demonstrated here, to explicate such methodological problems and suggest solutions, within the framework of an objective theory of evidence. I consider the error-statistical account as both a theory of evidence and as a theory of inference. I seek to show how inferences regarding the truth of hypotheses can be upheld by avoiding a certain kind of alternative hypothesis problem. In addition to the testing of assumptions behind the experimental model, I discuss the role of judgments of implausibility. A benefit of my analysis is that it reveals a continuity in the application of error-statistical assessment to low-level empirical hypotheses and (...) highly general theoretical principles. This last point is illustrated with a brief sketch of the issues involved in the parametric framework analysis of tests of physical theories such as General Relativity and of fundamental physical principles such as the Einstein Equivalence Principle. In modern times the idea of the objectivity of law has been undermined by skepticism about legal institutions, disbelief in ideals of unbiased evaluation, and a conviction that language is indeterminate. Greenawalt here considers the validity of such skepticism, examining such questions as: whether the law as it exists provides determinate answers to legal problems; whether the law should treat people in an "objective way," according to abstract rules, general categories, and external consequences; and how far the law is anchored (...) in something external to itself, such as social morality, political justice, or economic efficiency. This book is a systematic reappraisal of Leibniz’s philosophy of mind. The main argument of this book is easy to state: Leibniz offers a fully natural theory of mind. In today’s philosophical climate, in which much effort has been put into discovering a naturalized theory of mind, Leibniz’s efforts to reach a similar goal 300 years earlier will provide a critical stance from which we can assess our own theories. But while the goals might be similar, the content of Leibniz’s (...) theory significantly diverges from the majority of today’s theories. Leibniz’s philosophy of mind meets the standards of what he would regard as a fully natural theory. Perhaps surprisingly, Leibniz’s theological commitments yield a thoroughgoing naturalizing methodology: the properties of an object are explicable in term of the object’s nature. This book argues that Leibniz pursued his philosophy of mind with this methodology in hand. If we keep this commitment to a naturalizing project in mind, then we will find in Leibniz a rich and interesting philosophy of mind. -/- This book provides an account of Leibniz’s naturalizing constraints and traces them through Leibniz’s philosophy of mind. This paper is concerned with the implication from value to fittingness. I shall argue that those committed to this implication face a serious explanatory challenge. This argument is not intended as a knock-down argument against FA but it will, I think, show that those who endorse the theory incur a particular explanatory burden: to explain how counterfactual favouring of actual value is possible. After making two important preliminary points I briefly discuss an objection to FA made by Krister Bykvist a (...) few years ago. The point of discussing this objection is to enable me to more easily present my own, and I believe stronger, version of that objection. The overall argument takes the form of, simply, a counterexample which can be constructed on the back of of my two preliminary points. Throughout the paper I try to respond to various objections. If "racial memory" is a viable concept, then the enduring paradigm of human productivity is agriculture, whose seventy-century dominion Western industry and urbanization have eclipsed only (...) within the last two hundred years. The fifteen essays collected here explore America's distinctive form of agrarianism: where individualism, democracy, and a seemingly endless frontier transcended European quarrels over "commons" versus "containment." These values also helped forge our indigenous philosophy—pragmatism—and it is the confluence of these two distinctive American forms that intrigues each of these authors.The essays fall roughly into three groups: 1) historical queries whose connection to pragmatism is marginal, 2) expositions of the agrarian roots of pragmatism, and 3) estimates of the influence of classical pragmatism on the recent rise of neoagrarianism. The first category offers sparkling essays by Charles Taliaferro, James Campbell, Paul B. Thompson, Robert S. Corrington, and Douglas R. Anderson. Together these scholars sketch a history from colonial times to the mid-twentieth century—from Jefferson's "noble agrarian" to the agony of reconstruction, which hastened the split between Northern transcendentalists and Southern romantics. There are some surprises: Franklin outshines even Jefferson with his balanced vision of self-improvement and community weal, and Jefferson's correspondent Crèvecoueur emerges as a visionary who foresaw farming as a wholesome and integrated way of life a century before Emerson and Thoreau. Thomas C. Hilde finds an engagingly pragmatic notion of community in Josiah Royce, and Richard E. Hart discovers Dewey's sense of concrete experience in the novels of John Steinbeck. The contributions of neglected figures such as Francois Quesnay, Liberty Hyde Bailey, John Brewster, and A Whitney Griswold are also recovered.Turning to the second group, though obviously an irresistible title the notion that classical pragmatism is robustly "rooted" in agrarianism is slightly disingenuous. Peirce and James have no direct ties to agrarianism. And though Dewey's themes of innovation, social intelligence, community, and a conception of experience broadly inclusive of organisms and environments reflect obvious affinities, they do not show that pragmatism grew directly from or is a variant of agrarianism. Happily, the pieces on Dewey contributed by Larry A. Famously, scientific theories are underdetermined by their evidence. This occurs in the factor analytic model, which is often used to connect concrete data to hypothetical notions. After introducing FA, three general topics are addressed. Underdetermination: the precise reasons why FA is underdetermined illuminates various claims about underdetermination, abduction, and theoretical terms. Uncertainties: FA helps distinguish at least four kinds of uncertainties. The prevailing practice, often encoded in statistical software, is to ignore the most difficult kinds, which are essential to FA's (...) underdetermination. Amidst long-running debates within the field, high energy physics has adopted a statistical methodology that primarily employs standard frequentist techniques such as significance testing and confidence interval estimation, but incorporates Bayesian methods for limited purposes. The discovery of the Higgs boson has drawn increased attention to the statistical methods employed within HEP. Here I argue that the warrant for the practice in HEP of relying primarily on frequentist methods can best be understood as pragmatic, in the sense that statistical methods (...) are chosen for their suitability for the practical demands of experimental HEP, rather than reflecting a commitment to a particular epistemic framework. In particular, I argue that understanding the statistical methodology of HEP through the perspective of pragmatism clarifies the role of and rationale for significance testing in the search for new phenomena such as the Higgs boson. In 1710 G. W. Leibniz published Theodicy: Essays on the Goodness of God, the Freedom of Man, and the Origin of Evil. This book, the only one he published in his lifetime, established his reputation more than anything else he wrote. The Theodicy brings together many different strands of Leibniz's own philosophical system, and we get a rare snapshot of how he intended these disparate aspects of his philosophy to come together into a single, overarching account of divine justice in (...) the face of the world's evils. At the same time, the Theodicy is a fascinating window into the context of philosophical theology in the seventeenth century. Leibniz had his finger on the intellectual pulse of his time, and this comes out very clearly in the Theodicy. Leibniz's Theodicy remains one of the most abiding systematic accounts of how evil is compatible with divine goodness.
